ISLAMABAD: Chief Justice Iftikhar Mohammed Chaudhry noted during the hearing of the reference to Bhutto case that it was for the reopening of cases of murder ZAB, but the presidential reference had not formulated any legal questionGeo News announced Monday evening.
CJ has asked the Federal Government to eliminate errors of law, the draft of the presidential reference case, urging that the legal objections should be removed prior to the formation of a bench of expansion of the Court to hold hearing.
In addition, SC asked the Federal Government to rewrite reference of President Asif Ali Zardari.
The SC said that the reference should be rewritten in accordance with section 186 of the constitution.
A bench of three members, chaired by the Chief Justice Iftikhar Mohammad Chaudhry heard the case today.
At the hearing, Chief Judge interviewed the opportunity to examine the case through the reference already filed. He said legal objections must be processed before forming a larger bench to hear the case.
The Chief Justice Iftikhar Mohammad Chaudhry noted that, in the past, all references filed had a clear cut issue, but it is unfortunate that this was not the case with this reference.
The Chief Justice also said that he did not know what would be the outcome of the case, but it would raise important questions at the hearing.
Later, the hearing was adjourned till April 21.
Article 186 of the constitution authorizes the President to designate any legal question of the Supreme Court for its opinion, obliging the responding apex court.
Thursday, the Chief Justice said that the President not formulated a question of law in its reference to the Supreme Court. He said that there were three decisions of the separate Court against former Prime Minister and President Zardari did not specify that you would like to have reviewed.
